US FlagUS/Silver Spring: Byrne Dairy, Inc., a Syracuse, New York establishment, recalls an estimated 250 cartons of Byrne Dairy branded Mighty Fine Chocolate Ice Cream products from the American marketplace due to suspected mislabeling and consequential undeclared Peanuts, a known allergen, source of dietary intolerance and possible trigger of Anaphylaxis, a serious and potential fatal situation, requiring immediate medical intervention to minimize pain and suffering as well as prevent life-altering injury or death.

The US Food and Drug Administration (“FDA”) reports the following Dairy products are subject to this recall:

  • Byrne Dairy Mighty Fine Chocolate Ice Cream, sold in half-gallon cardboard containers with a last date of sale designation of 10/4/2024

Please consult the photograph above for details of the food’s packaging, design and retail presentation.

==> No barcodes, UPCs, item numbers, best-before date codes, manufacturing date codes, production dates, regulatory approval designations, registration numbers, agency approval designations or other identification numbers were listed with this recall notification.

These Dairy products were known to be marketed, distributed and sold in the US state of New York, although it is always possible these food products had wider distribution within the country. When in doubt, please contact the manufacturer for specific product information.

Logo - US Food and Drug Administration ("FDA")According to the FDA, Byrne Dairy has recalled an estimated 250 cartons of Byrne Dairy Mighty Fine Chocolate Ice Cream from the American marketplace due to suspected mislabeling and consequential undeclared Peanuts. As a result of this reported defect, you should neither serve nor consume the recalled Dairy products identified above.

In this case, this recall was initiated after Byrne Dairy received a consumer complaint that Ice Cream containing Peanut Butter was distributed in packaging that did not reveal the presence of Peanuts due to mislabeling of the product.

==> Never depend on your senses of sight, smell, taste or touch to confirm food poisoning, adulteration or contamination. If in doubt about the safety of any food, return it to your retailer for refund or toss it out in your household garbage, making sure neither small children nor household pets can access the suspect food.

Proposed Remedy:
If you believe you have purchased or have in your possession any of these recalled Byrne Dairy Mighty Fine Chocolate Ice Cream products and could be allergic to their Peanut ingredients, have a close family member who is allergic or has previously experienced Anaphylaxis or are unsure of your allergy status, please do not consume them directly nor use them as an ingredient in another dish or preparation. Instead, return the product to the store where you purchased it for a full refund.

==> If you have a medical emergency, please contact 9-1-1, your closest hospital or emergency center equipped to properly treat Anaphylaxis.
