US NHTSA Recalls: Volvo Vehicles

Among the ninety-three (93) recalls the NHTSA announced in September came news of the following:

Logo - Volvo Car USA LLCVolvo Car USA LLC (“Volvo”), a Rockleigh, New Jersey establishment and a division of the Volvo Group of Gothenburg, Sweden and a subsidiary of the Chinese automotive concern Geely Automotive, has recalled an estimated 19,149 model year 2021 Volvo XC40, Volvo XC 40 Recharge, Volvo V60CC, Volvo V90, Volvo V90CC, Volvo XC90, and 2021-2022 Volvo V60, Volvo XC60, Volvo S60 vehicles marketed, sold and delivered in the United States.

Recall Category: Seat Belts – Seat Belt Locking Retractor malfunction in apparent contravention of FMVSS 208

NHTSA Safety Notification 21V682000 reports the Seat Belt Automatic Locking Retractors may deactivate early, which can prevent the Child Restraint System from securing properly. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 208, “Occupant Crash Protection.”

According to the NHTSA, an unsecured Child Restraint System can increase the risk of injury during a crash, motor vehicle collision (“MVC”) or other impact event with consequential serious injury and/or life-changing results.

Please note that under 49 United States Code § 30112(a), it is illegal for anyone, including a manufacturer, distributor, dealer or retailer to sell an item of equipment or vehicle that fails to comply with all applicable Federal motor vehicle safety standards.

Proposed Remedy:
Authorized Volvo Dealers will inspect and replace the Seat Belt Assemblies, as necessary, free of charge. Owner notification letters are expected to be mailed October 31, 2021. Owners may contact Volvo Car Customer Service toll-free at 1-800-458-1552 during normal business hours, Monday to Friday, Eastern Standard Time (“EST”) for more information. Volvo Car’s designation for this recall is R10111.
