US FlagUS/Washington: The US Department of Agriculture’s Food Safety and Inspection Service (“FSIS”), a statutory regulatory and food safety authority, warns against consuming an estimated 165 pounds of frozen Siluriformes Fish products imported by EB Express Provisions Inc. (“EB”), a Newark, New Jersey establishment and Importer of Record, due to reported importation from Brazil, a country ineligible to export Siluriformes Fish products into the United States.

The United States Department of Agriculture (“USDA”) reports the following Siluriformes Fish were produced and imported from Brazil to the United States on or about April 23, 2021. and are subject to this warning:

  • EB Express Provisions Gutted Frozen Fish, Scientific Name: Hypostomus, sold in 13-14 pound cases with a stated production date of 23/04/2021. The Whole Frozen Fish products were reportedly removed from the cases and sold individually, by weight, in plastic bags at Mineirão Market stores in Massachusetts.

==> No barcodes, UPCs, NDCs, DINs, item numbers, best-before date codes, manufacturing date codes, expiry dates, regulatory approval designations, registration numbers, agency approval designations or other identification numbers were listed with this recall notification.

According to the USDA, this warning was issued when the FSIS followed up on a referral from USDA’s Smuggling Interdiction & Trade Compliance Program, regarding Cascudo Fish (Hypostomus sp), of the order Siluriformes, product of Brazil. As stated above, Brazil is not eligible to import raw Siluriformes products into the United States.

The recalled Fish products are identified with an ineligible establishment number (“S.I.F. 188”) on their packaging. The Fish does not bear a USDA mark of inspection. These items were shipped to retail locations in Massachusetts. A formal recall was not recommended in this case because it is believed that the affected Fish products are no longer available to be purchased by consumers.

The FSIS is concerned, however, that some product may be in your freezers, chillers or refrigerators. Anyone concerned about an illness should contact a health care provider. If you have purchased these Siluriformes Fish products are urged not to consume them. Instead, these products should be thrown away or returned to the place of purchase.

==> Never depend on your senses of sight, smell, taste or touch to confirm food poisoning, adulteration or contamination. If in doubt about the safety of any food, return it to your retailer for refund or toss it out in your household garbage, making sure small children and pets can’t access the suspect food.
