US NHTSA Recalls: BMW 228i xDrive & M235i xDrive Vehicles

Among the eighty-four (84) recalls the NHTSA announced last month, came news of the following:

Logo - BMW of North America, LLC.BMW of North America, LLC (“BMW”), a Greer, South Carolina establishment and a subsidiary of Bayerische Motoren Werke AG of Munich, Germany, has recalled an estimated 14,011 model year 2020-2021 228i, 228i xDrive, and M235i xDrive vehicles marketed, sold and delivered in the United States.

Recall Category: Visibility – Sunroof malfunction in apparent contravention of US FMVSS 118

NHTSA Safety Notification 21V091000 reports if the driver initiates an automatic closure of the Sunroof, and the vehicle’s key status is changed to “OFF” or “LOCK”, the Sunroof may continue to close. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 118, “Power-operated Window Systems.”

According to the NHTSA, if the Sunroof continues to close after the vehicle is shut off, it may increase the risk of injury, including consequential laceration, concussion, amputation, bone fracture, choking and/or other life-changing results.

==> If you have a medical emergency, please contact 9-1-1, your closest hospital or emergency center equipped to properly treat lacerations, concussions, bone fractures, amputation, central nervous system (“CNS”) damage and/or internal injuries.

Please note that under 49 United States Code § 30112(a), it is illegal for anyone, including a manufacturer, distributor, dealer or retailer to sell an item of equipment or vehicle that fails to comply with all applicable Federal motor vehicle safety standards.

BMW will notify registered owners, and dealers will update the Sunroof Electronic Coding Software, free of charge. The recall is expected to begin April 12, 2021. Owners may contact BMW Customer Service toll-free at 1-800-525-7417 during normal business hours, Monday to Friday, Eastern Standard Time (“EST”) for more information. No manufacturer’s designation was listed for this recall at press time.
