US FlagUS/Washington: The US Department of Agriculture’s Food Safety and Inspection Service (“FSIS”), a statutory regulatory and food safety authority, has issuing a Public Health Alert for certain Raw Frozen New Orleans Roasted Chicken Wings imported and labeled with a false USDA mark of inspection with consequential risks of bacterial and/or viral infection, severe illness and/or possible life-changing complications, all serious health hazards.

Additional information:
The United States Department of Agriculture (“USDA”) reports the following Frozen Chicken products are subject to this warning:

  • Chicken Arrived, Organic Chicken, New Orleans Roasted Chicken Wings, sold in 600 gram plastic bags with a best-before date of 09/19/2021 written in Mandarin Chinese

==> No barcodes, UPCs, NDCs, DINs, item numbers, best-before date codes, manufacturing date codes, production dates, expiry dates, regulatory approval designations, registration numbers, agency approval designations or other identification numbers were listed with this food warning notification.

Please consult the photograph above for details of the food’s packaging, design and retail presentation. One (1) additional image of the subject Chicken Wings can be found on the Web site above.

According to the USDA, the Chicken Wing products were shipped to one (1) location and then further distributed to twenty (20) different retail locations within California, Oregon and Washington states. The Frozen Chicken Wing products are labeled with a false/counterfeit USDA mark of inspection bearing “P-40478”, an establishment number that does not exist. Di-Da Di-Da USA Corp., a Saratoga, California establishment, received and distributed ineligible imported Frozen Chicken Wing products from the People’s Republic of China (“PRC”) to US commerce for retail sale.

The problem was discovered when the FSIS received a consumer complaint reporting a product suspected of being illegally imported into the country was being sold at retail. After investigation, the FSIS determined that the product was ineligible and had been misbranded with a false USDA mark of inspection. As a result of these reported defects, you should neither serve nor consume the Frozen Chicken products identified above.

==> Never depend on your senses of sight, smell, taste or touch to confirm food poisoning, adulteration or contamination. If in doubt about the safety of any food, return it to your retailer for refund or toss it out in your household garbage, making sure small children and pets can’t access the suspect food.

A formal recall was not ordered by the USDA because it is believed the affected Chicken Wings are no longer available in commerce for US consumers to purchase. If you believe you have purchased or have in your possession any of the subject Roasted Chicken Wings, however, please do not consume them directly nor use them as an ingredient in another dish or preparation. Instead, kindly return the product to the store where you purchased it for a full refund.
